These Terms & Conditions ("Terms") govern your access to getnuvia.co (the "Site") and your purchase of products from Hydrascale Technologies LLC ("Hydrascale," "Nuvia," "we," "us," or "our"), a company registered in Delaware, United States, with address 254 Chapman Rd, Newark, DE 19702, United States. By using the Site or placing an order you agree to these Terms.
If you are a consumer resident in the EU/EEA, you benefit from the mandatory protections of the law of your country of residence. Nothing in these Terms limits those rights — including your legal guarantee of conformity and your right of withdrawal.
1. Eligibility
You must be at least 18 years old and able to enter into a binding contract.
2. The products
Nuvia offers a range of consumer dietary supplements (food supplements) and wellness products. Food supplements are foodstuffs intended to supplement a normal diet; they are not medicinal products and are not intended to diagnose, treat, cure, or prevent any disease. Consult your healthcare provider before use, especially if you are pregnant, nursing, taking medication, or have a medical condition.
3. Account and information accuracy
You agree to provide accurate, current, and complete information for your order and account and to keep it updated. You are responsible for activity under your account.
4. Orders, prices, VAT, and payment
- An order placed through the Site is an offer to purchase, subject to our acceptance and to availability. A contract is formed when we send you an order/dispatch confirmation.
- Prices are shown in euro (€) and include applicable VAT for consumers. The total price, including taxes and any delivery charges, is displayed before you complete your order.
- For deliveries from outside the EU, import VAT, customs duties, or handling fees may apply; see our Shipping Policy for how these are handled.
- We may correct obvious pricing or typographical errors and cancel affected orders, notifying you and refunding any amount paid.
- You authorise us and our payment processor to charge your selected payment method for the order total.
5. Delivery and risk
Delivery terms, areas, and times are described in our Shipping Policy. Risk of loss or damage passes to you when you (or a third party you name, other than the carrier) take physical possession of the goods.
6. Right of withdrawal and returns
As an EU/EEA consumer you have a 14-day right of withdrawal, and we also offer a voluntary satisfaction guarantee. Both are described in our Right of Withdrawal & Refunds policy, incorporated by reference.
7. Legal guarantee of conformity
Goods must conform to the contract. As a consumer you are entitled to the statutory legal guarantee of conformity under EU law (Directive (EU) 2019/771) and your national law: if goods are defective or not as described, you are entitled to have them brought into conformity (repair or replacement) or to a price reduction or refund, at no cost to you, as provided by law.
8. Intellectual property
The Site and its content (text, graphics, logos, images, and the "Nuvia" name and our product names and marks) are owned by or licensed to Hydrascale and protected by law. We grant you a limited, non-exclusive, non-transferable licence to access the Site for personal, non-commercial use. You may not copy, reproduce, or create derivative works without our permission.
9. Acceptable use
You agree not to misuse the Site, including by attempting unauthorised access, interfering with its operation, scraping, or using it for unlawful purposes.
10. Disclaimers
The Site is provided "as is" and "as available." We take reasonable care to keep product information accurate, but to the extent permitted by law we do not warrant that the Site will be uninterrupted or error-free. Product information (including ingredients and usage) is provided for general information; always read the label before use. This Section does not affect your statutory rights as a consumer.
11. Liability
Nothing in these Terms excludes or limits our liability where it would be unlawful to do so — including liability for death or personal injury caused by our negligence, for fraud, or under mandatory consumer-protection law. Subject to that, we are not liable for losses that were not reasonably foreseeable, or for loss or damage not caused by our breach. Your statutory rights as a consumer are unaffected.
12. Governing law and jurisdiction
These Terms are governed by the laws of the State of Delaware, United States. However, if you are a consumer habitually resident in the EU/EEA, you also enjoy the protection of the mandatory provisions of the law of your country of residence, and you may bring proceedings in the courts of that country. Nothing in this Section deprives you of that protection.
Online Dispute Resolution: EU consumers may submit disputes to the European Commission's ODR platform at https://ec.europa.eu/consumers/odr.
13. Changes to these Terms
We may update these Terms. Changes are effective when posted with a new Effective date and apply to orders placed afterwards. Your continued use of the Site after changes constitutes acceptance.
